ii. Lemon Test: From Lemon v Kurtzman (1971): All laws concerning religion must pass these three ideals if considered constitutional: 1) The statute must have a secular legislative purpose. (also known as the Purpose Prong) 2)The principal or primary effect of the statute must not advance nor inhibit religious practice (also known as the Effect Prong) 3) The statute must not result in an "excessive government entanglement" with religious affairs. (also known as the Entanglement Prong) iii. Lemon Test has been used to stop unconstitutional practices in the following ways: a. No government imposed mandatory prayers in school b. Prayers at public school graduation ceremonies c. No student led mandatory prayers at sporting events d. Government cannot ban certain groups from using public university of public schools buildings for religious worship or for group gatherings. e. Public universities cannot withhold funds from student groups based on religious orientation A couple of pre-international law pieces: League of Nations- 1918- President Wilson- religious freedom and non-discrimination (not for racial minorities). Atlantic Charter- 1941- freedom of expression, religion, from want, from fear (Roosevelt) ‘New world order’ Universal Declaration of Human Rights (1948) Article 2: Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty. Article 16: (1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. Article 18: Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.
